There are several methods of settling oil and gas disputes and our attorneys are adept at executing all of them. Such disputes can be handled by one of the following means.

Arbitration

Arbitration is the most common means to resolve a dispute because this arrangement is less expensive and more expedient than litigation. During arbitration, the court typically chooses the arbitrator by issuing a list of possible candidates to both parties. Each party has the ability to object to individuals found unacceptable, after which the court assigns a neutral, disinterested arbitrator to the case. This process offers both parties more control than they would have in a court of law. In addition, arbitration has the advantage of keeping the dispute more confidential than a court proceeding would.

Litigation

Both parties in the dispute typically try to avoid litigation which is much more costly and time-consuming than arbitration. Litigation is, of course, also more adversarial, more likely to result in a winner and loser than in two satisfied parties.

Expert Determination

A less frequently used means of dispute settlement is expert determination. Although similar to arbitration, expert determination is usually limited to the resolution of specific issues of fact. In such cases, the decision-maker is an expert in a very particular area who is hired to target and decide a precise issue. In cases of expert determination, the decision-maker does not make binding determinations of law, decide liability or award damages. In cases in which expert determination is appropriate, however, a great deal of time and money can be saved by everyone involved.
