|A consumer is defined as anyone who seeks or acquires by purchase or lease any goods or service. Although most transactions by a consumer involve major corporations with seemingly unlimited resources to protect themselves against legal claims, Chandler Mathis & Zivley can help those who may have been victimized. |
Deceptive trade practices
Most consumer transactions are covered under the Deceptive Trade Practices Act. The elements that need to be proven in a DTPA case are:
1. The Plaintiff was a “consumer” as that is defined in the statute,
2. The Defendant committed one or more of the false, misleading or deceptive acts or practices that are listed in the statute,
3. The Plaintiff relied on the deceptive practice to their detriment and
4. The Defendant’s false, misleading or deceptive act or practice caused a financial injury to the Plaintiff.
As experienced consumer law litigators, we at Chandler, Mathis & Zivley are well versed in consumer protection laws and utilize them to pursue compensation you may be due. We are also aware that some statutes concerning deceptive trade practices do have inherent limitations, which is why we carefully study each case to make sure we properly and efficiently pursue compensation for our clients.
